1. Introduction

These Terms of Use (hereinafter "Terms") set forth the conditions for using Lightstick Controller (hereinafter "LSCon" or "the App"). By downloading or using this App, you agree to be bound by these Terms.

These Terms were originally drafted in Japanese. This English translation is provided for your convenience only. In the event of any discrepancy between the Japanese version and this translation, the Japanese version shall prevail.

2. Overview of the Service

This App is developed and operated by an individual as a personal hobby project. It is designed to control the color and patterns of Bluetooth Low Energy (BLE) compatible penlight devices, enabling users to enjoy their fan activities. It provides features for creating and playing scores (performance programs) and managing setlists.

Unlike commercial services, this is a personal project, and therefore no guarantees are made regarding support availability or update frequency.

3. Terms of Use

3.1 Target Users

This App is intended for users aged 13 and older.

3.2 Compatible Devices

This App requires a BLE-compatible iOS device and a BLE-compatible penlight. Compatibility with all BLE devices is not guaranteed.

3.3 Prohibited Activities

The following activities are prohibited:

• Using this App for any illegal purpose
• Reverse engineering, decompiling, or modifying this App
• Interfering with other users through the use of this App
• Disrupting or interfering with the servers or network functions of this App
• Any activity that may interfere with the operation of this App
• Impersonating other users
• Providing benefits, directly or indirectly, to antisocial forces in connection with this App
• Unauthorized commercial use of this App (e.g., selling score data)
• Any other activity deemed inappropriate by the developer

4. Subscriptions

4.1 Free and Paid Plans

The basic features of this App are available free of charge. By subscribing to the paid plan (Single), you gain access to the following additional features:

• Creating and playing setlists
• Unlimited score creation
• Unlimited score duration
• Score export functionality

4.2 Pricing and Payment

• Subscription pricing is as displayed on the App Store product page.
• Payment is processed through the payment method linked to your Apple ID.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

4.3 Cancellation and Refunds

• You can cancel your subscription through iOS Settings > Apple ID > Subscriptions.
• Refunds are subject to Apple's refund policy. The developer of this App cannot process refunds directly.

5. Disclaimer

5.1 BLE Communication and Devices

• The stability of BLE communication may vary depending on the distance between devices, radio wave conditions, and surrounding equipment. The developer assumes no responsibility for communication interruptions or delays.
• The developer assumes no responsibility for any malfunction, damage, or breakage of penlight devices caused by the use of this App.
• This App is not an official application or service of any penlight manufacturer, artist, or event organizer. It controls devices in ways that may not be covered by manufacturer support. Please do not contact penlight manufacturers or artist/merchandise support regarding this App.
• Device control via BLE communication is performed at the user's own risk.
• Changes to device firmware or protocols may cause this App to cease functioning properly. The developer assumes no responsibility for damages resulting from such changes.

5.2 Use at Events

• When using this App at live events, concerts, or similar venues, please follow the venue rules and instructions from event organizers.
• The developer assumes no responsibility for any trouble arising from the use of this App during events.

5.3 Data

• All App data (scores, setlists, settings, etc.) is stored locally on your device. The developer assumes no responsibility for data loss due to device failure, app deletion, OS updates, or similar causes.
• We recommend backing up important score data using the export feature.

5.4 General Disclaimer

This App is developed as a personal hobby project and is provided "AS IS." No warranties, express or implied, are made, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, the developer shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of this App.

As this is a personal project, bug fixes and feature improvements are not guaranteed. Please understand this in advance.

6. Intellectual Property

Copyright, trademark rights, and other intellectual property rights related to this App belong to the developer. The rights to content such as score data created by users using this App belong to the respective users.

7. Handling of Personal Information

The handling of users' personal information in connection with the use of this App shall be governed by the separately established "Privacy Policy." Users are deemed to have agreed to this Privacy Policy by using the App.

8. Changes to or Termination of the Service

The developer may change the content of this App or terminate the provision of this App without prior notice to users. The developer assumes no responsibility for any damages incurred by users due to changes to or termination of this App.

9. Notification Methods

Notifications to users shall be made through in-app displays, postings on this App's website, or other methods deemed appropriate by the developer.

10. Changes to These Terms

The developer may modify these Terms as necessary. If significant changes are made, users will be notified within the App. Continued use of this App after such changes constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any disputes related to these Terms.

Notwithstanding the foregoing, if mandatory consumer protection laws of your country or region of residence provide you with rights that cannot be waived by agreement, those rights shall apply to the extent required by such laws.
